Thanks for visiting this page. It is a compilation of questions I have answered on various websites and in articles I’ve written and been quoted in. Time has a tendency to wear a little bit on questions regarding real estate. If something here doesn’t sound quite right, let me know and I will give you an up-to-date answer.

Many of these questions below are from forums of qualified agents who contribute their knowledge and expertise to members of the public. I didn't write any of the questions, but I did write all of the answers.

Please keep in mind that there are a lot ‘real estate experts’ out there who don’t mind telling you how things work. Ask them how many buyers and sellers they have represented in their career. I run into a lot of agents who have only sold a handful of homes and give advice that could be detrimental to your financial wellbeing. I’ve sold an average of 25 single family homes, condos, townhomes, and multi-family properties a year since 1985. That’s over 600 so far.

And again, I really did write the responses myself. For authenticity I have not changed any spelling or grammar found in the original questions.

1) Can I get two loans on a house purchase? I am a first time home buyer. Would a bridge loan work in this case?

2) In the Supplemental Seller’s Checklist, if the Seller answers “yes” to the question, “Has the Seller (or an unlicensed person) completed any electrical repairs on the house”, and then the house sold “As- Is” does the owner still hold liability? 

3) I checked current “active” listings for Palo Alto area under 1.75M, none of the houses look reasonably priced to me, am I being unrealistic? Are any of the MLS listed houses well worth the price tag?

4) How difficult is buying a lot (land) and then getting your house built? Is it cheaper?

5) Final walk through – We did the final walk through today and our loan funded today. There are stains on the ceiling that weren't there when we last saw the house. What can we do now?

6) As Buyers, if we discover something on our final walk-though that was not there when we purchased, like the leaking roof in the prior question, does the “3 day rescission” apply?

7) If I take a property “As-Is” does that mean I can’t do any inspections?

8) How can I tell what High School my kids would go to based on a street address?

9) Will my impound account money be used (or will I get it back)? 

10) Several predictions in the media expect that high-end home prices (> $1 million) will suffer a significant drop in the year 2010 and 2011 due to mortgage interest reset for ARM borrowers, and the high unemployment rate. Can anyone predict home prices in Los Altos in 2010?

11) Is there supposed to be a transfer tax when you do a refi in Santa Clara County?

12) Is it illegal to negotiate directly with the seller?

13) Buzz about Realtors Rebate? Does anybody know anything about this new Realtors Rebate in San Jose area.

14) We are in a contract with a house and used the PRDS contract to submit the offer. Our financial contingency expired and we have not yet received the appraisal. So if the appraisal comes back and if it is valued very low compared to our offer price can we still renegotiate or back off?

15) Backing out of an offer during contingency period. How should I notify the seller and selling agent in writing? 

16) Is it OK to have two agents at a time before finalizing on a home?

17) Do you think the house prices will drop more after the tax credit is expired?

19) In California can you short sell your home to your live-in girlfriend? Can you both continue living in the house? 

20) We received the Escrow Closing Statement from our Escrow/Title Company. As part of the purchase contract, it was agreed that the seller will pay for Escrow Fees and Owner's Title insurance. However the statement shows the Title Charges to be paid by the buyer/us. Are Title Charges considered to be part of Escrow fees/Title Insurance fees? Shouldn't the seller be paying for this?

21) My son was laid off from his job last year. His unemployment is due to run out very soon and they won't be able to keep up with the mortgage payment. At this point, what are their options?

22) My agent told me that short sale houses take forever to buy and don't even try it. So, what is the purpose of a short sale listing? Who usually can buy those?

23) Is Now A GOOD Time to buy a HIGH PRICE home ? (Range = 1.7M -2.5M) in the so called very desirable neighborhood of bay area such as Los Altos, Saratoga, Palo Alto, Menlo Park, Los Gatos, Monte Sereno, Atherton, Etc?

24) How can I find out how many bids have been made on a house for sale? Is there any website that will tell me how many offers have been made on a house for sale?

25) What is an ‘escalation clause’ or a ‘sharp bid’?

26) Can the financing term be different from the purchase contract? My client wanted to do 20% down initially and that is what I put in the accepted purchase contract. Now he wants to go for an FHA loan. Do I need to rewrite the contract and resubmit the offer?

27) We bought a townhome March 2007 for $480K now it is valued at $250K. What should we do?

28) URGENT HOME APPRAISAL QUESTION - I am in the process of buying a home. The home was appraised for $20k less than the list price. The appraiser, and the two agents involved have gotten their information from different resources and this has caused the discrepancy. Can someone please explain the possible reason behind this discrepancy?

29) I am planning to place an offer through the listing agent. In California, is it legal to ask for incentives from the listing agent?

34) The Seller won’t sign title documents due to fight with his agent. I am the buyer and I just signed all the title documents and gave them my funds for the house.What do I do now?

35) We have our home for sale now in Willow Glen. We are thinking of pulling it off the market and trying again in early spring of 2010. We don't need to sell right now, but would like to move out of state. Should we wait for a better market next spring?

36) Can LEED certification add value to my home? I recently built a LEED Gold certified green home in Mountain View, CA. When I had it appraised, I was told that there is no added value to have this certification. Is this true? Should I have my home re-appraised?

37) Is New Valley Continuation high school the ONLY public high school option for Reynor Park area? Is this the only public high school for kids to go to, or do the kids have the option to attend other local public high schools- ie. Fremont high?

38) What should I do - put more on towards down payment or instead use it to pay points on loan? Which is better (more advantageous) for me as a buyer?

39) How do you know what schools you can apply for based on the home address?

40) "Inundation area" - Should we avoid buying homes around? What is the risk of living around an inundation area?

41) How important is a realtor in getting an offer accepted? If I am placing an offer on a house I am interested in purchasing, how important of a role does my realtor play in getting my offer accepted? Or does it all depend on the purchase price?

42) I'm selling a house ‘as-is’. The buyers accepted ‘as-is’ and conducted termite and foundation inspections on their own. 1.) Did they need my permission to do the inspections? 2.) Am I obligated to read the reports? 3.) Is my real estate agent obligated to see and send me the reports from the buyers?

43) B of A PMI Games? Just signing a loan with Bank of America and I’m putting 10% down. But the contract says that PMI doesn't come off until I get to 75% equity. What's up with that? You have to have 20% down to avoid PMI and 25% to get off of it? And they sprung this on me at the signing. Are they trying to pull a fast one on me? What can I do about this?

44) Accepting PITI or pushing back closing date? My fiancé and I presented an offer for a house along with 2 other parties. The seller presented a counter offer to us stating that they want to stay in the house for 30 days after closing date and they would pay for PITI. Should we push back the close of escrow date? or should we accept the PITI? What are the potential problems to either of the arrangements?

45) Why is there a difference in the price range for a given house in Zillow, cyberspace and appraisal.com? Why is there such a difference? And what bases do they calculate these price range?

46) What does pending release mean? When is it pointless to look at these listings?

47) We're considering the purchase of a small single family home. It has a variety of upgrades and remodeling, some done without permits and by unlicensed contractors. The research we've done so far suggests that there is risk of the county/city asking that the conversion be reversed and fees & penalties may be applied. Is the only action now to check w/county and figure out the potential costs to rectify; or just ignore it?

48) How concerned should I be about the unpermitted garage conversion (to family room)?

49) How hard is it to get a Realtor to show you properties on a few days notice when you have no pre-approval?

50) When is it time for a new agent?

51) What is the current commission rate for a realtor that is representing a seller in Santa Clara?

52) I own .96 acre near DeAnza College, with an old house. How can I estimate the land itself per sq.ft. without comparables?

53) Can PMI be based on assessed value to loan amount instead of selling price to loan?
